This page presents BLAM’s general terms and conditions of sale for the general public. BLAM is a brand of BLAM SAS, registered under the number SIREN 809412844 RCS Annecy with a capital of 42 910,00€, domiciled at 418 route de Mornaz Haut, 74150 Vaulx.
The parties expressly undertake to perform this agreement in good faith and with loyalty, and to conduct all subsequent negotiations directly or indirectly related to this contract in this spirit. This contract is governed by French law. The language of this contract is French. In the event of a dispute, the French courts shall have sole jurisdiction. The names of the games are trademarks of BLAM SAS.
The present contract defines the conditions under which the CLIENT and BLAM perform their contractual obligations to each other.
The prices of our products are indicated on the site in Euros and include all taxes. BLAM reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in effect at the time orders are registered, subject to availability.
Orders are placed on the initiative of the CLIENT. The CLIENT places an order on the www.blam-edition.com website by downloading the order form or by placing an order directly via the online store. Sending the order form by the CLIENT implies acceptance of the terms and conditions of sale. Validation of the order by BLAM is effective upon receipt of payment of the order by the CLIENT.
Our product offers and prices are valid as long as they are visible on the site, while stocks last. For products not stocked in our warehouses, our offers are subject to availability from our suppliers. If a product is unavailable after you have placed your order, we will inform you by e-mail, telephone or post as soon as possible.
We work with La Poste. As far as possible, your order will be dispatched within 2 to 5 days. In general, the Post Office processes this type of parcel within 48 hours or 72 hours for metropolitan France. Before Christmas, the Post Office may be slowed down by the influx of parcels.
BLAM cannot be held responsible for non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, notably of postal services and means of transport and/or communications, flooding or fire.
You must check the conformity of the goods delivered at the time of delivery and before signing the delivery note and indicate on the delivery note and in the form of handwritten reserves accompanied by your signature any anomaly concerning the delivery (anomaly, damaged product…). You must also confirm these reservations to the carrier within two working days of receiving the item(s) and send a copy of this letter to BLAM, 418 route de Mornaz Haut, 74150 Vaulx. If products need to be returned, this must be done within three working days of delivery (article 105 of the French Commercial Code). Any claim made outside this period will not be accepted. Returns will only be accepted for products in their original condition (packaging, accessories, instructions, etc.).
The CUSTOMER has 14 days from delivery of the order to return it to BLAM. The item must be returned complete and in perfect condition, by registered mail, in its original packaging. Items returned incomplete, damaged or soiled by the Customer will not be accepted. Only the cost of return will be charged to the CLIENT. BLAM undertakes to reimburse the CLIENT for any sums already paid within 14 days from the date the order is returned to BLAM.
BLAM is the sole owner of the intellectual property rights to the works constituted by all of the components of the products sold (board, box, rules, cards, booklet, names). Consequently, BLAM has the exclusive right to grant third parties operating and marketing rights to all these games. As the present contract does not transfer to the CLIENT any material or intellectual property rights over the products ordered, the CLIENT agrees not to publish, distribute or market the content of the products in any way whatsoever.
BLAM reserves ownership of the products delivered until full payment of the price by the purchaser. Our retention of title applies both to the products and to the prices if they have already been resold. Law n° 80.335 of May 12 1980.
Unless disputed within 10 days of receipt, invoices are payable on the due date indicated on the invoice. Any sum not paid on the due date will give rise to the payment by the customer of penalties set at the refinancing rate of the European Central Bank, increased by 10 points. These penalties are payable ipso jure.
In accordance with articles 441-6 c. com. and D. 441-5 c. com. of the French Commercial Code, any delay in payment automatically entails, in addition to late payment penalties, an obligation for the debtor to pay a fixed indemnity of €40 for collection costs. An additional indemnity may be claimed, with supporting evidence, when the collection costs incurred exceed the amount of the fixed indemnity.
In accordance with the provisions of the French Consumer Code concerning “the mediation process for consumer disputes”, the customer has the right to free recourse to the mediation service offered by BLAM. The mediator is CM2C. This mediation service can be reached by :
BLAM provides spare parts for all of its products for a period of at least 24 months after the last product was placed on the market. Requests must be made by email to contact[at]blam-edition.com or by post to BLAM’s head office address. The documents will be made available within fifteen working days of receipt of the request.
BLAM undertakes to comply with the Loi Agec, by declaring the products it markets on its own behalf and under its own brand, under the unique identification number FR278114_12LUVO.
